Lassen county Board of Supervisors, County Counsel, Planning and Building Dept.
to discuss Lassen county Code for Cultivation of Marijuana

BACKGROUND: The Lassen
County amended Title 19 (Ordinance 2016-02) which allows cultivation of
marijuana for medical use on all unincorporated properties in the county. For parcels of less than one (1) acre, 12
marijuana plants are allowed. On parcels
of one (1) through ten (10) acres, 24 plants are allowed. Although the intent was for those with medical
marijuana cards (Compassionate Care Act, 1996), the ordinance allows for more
than what one patient needs. One person
noted that 24 plants would keep all of Stones residents stoned.
The SBCSD Board
is concerned that our community will suffer unanticipated consequences:
1. Excess water use as each
plant requires a minimum of five (5) gallons/day.
2. Increased fire danger as
the green waste from trimming and harvesting is highly flammable. With small properties, this is a fire hazard
for adjoining properties.
3. Increased traffic,
noise, fences and guard dogs.
4. Decreased property
values.
Stones-Bengard is zoned R-1-D.
Although residential, it is still unincorporated. We are asking for a legal opinion to see if
SBCSD may enact a more restrictive ordinance.
